1. COPYRIGHT
Copyright in the original artworks, paintings, canvases, sketches, photographs and other original artistic works created by Amélie Gianesin is owned by Amélie Gianesin, subject to the Copyright Act, R.S.C. 1985, c. C-42, and any applicable written agreement.
Copyright arises automatically when the requirements of the Copyright Act are met; registration is not required for copyright to exist. The author is generally the first owner of copyright, subject to statutory exceptions.
The purchase of an original artwork transfers ownership of the physical object only. Unless expressly agreed otherwise in a written agreement signed by the copyright owner, the purchase does not transfer copyright.
Copyright includes, among other rights, the exclusive right to reproduce the work or a substantial part thereof, communicate it to the public by telecommunication, and exercise the other rights provided by the Copyright Act.
Amélie Gianesin therefore retains the copyright in sold artworks unless copyright has been expressly assigned or licensed in writing.
Unauthorized uses
Without authorization, you may not:

reproduce or copy an artwork or a substantial part of it;

create or distribute reproductions, prints, merchandise or other products incorporating an artwork or a substantial part of it;

commercially exploit images of the artworks;

reproduce, adapt or otherwise use an artwork in a manner that infringes copyright or moral rights; or
-
falsely represent a reproduction as an original work by Amélie Gianesin.
Requests for licensing or commercial use should be directed to Amélie Gianesin.
Nothing in this policy limits any exception, limitation or other right available under Canadian law.
2. MORAL RIGHTS
Amélie Gianesin retains her moral rights in her works in accordance with the Copyright Act.
These rights include:

the right to the integrity of the work; and

the right, where reasonable in the circumstances, to be associated with the work by name or pseudonym, as well as the right to remain anonymous.
Moral rights cannot be assigned, but they may be waived in whole or in part.
Unless otherwise agreed by the artist, the artist does not authorize modifications or uses of her works that infringe her moral rights.
3. IMAGE USE POLICY
Images displayed on the AmeliArt website may be protected by copyright. Copyright in photographs is separate from copyright in the underlying artwork where applicable.
Except as permitted by law or expressly authorized by Amélie Gianesin, users may not reproduce, distribute, modify, commercially exploit, or create products incorporating images of the artworks.

Sharing a link to the AmeliArt website is permitted.

Social-media sharing through a platform's ordinary sharing functions does not constitute a general licence to download, reproduce, modify or commercially exploit the artworks or their images.

Nothing in this policy limits rights or exceptions available under Canadian law, including applicable fair-dealing and other statutory exceptions.
4. RESALE OF ORIGINAL ARTWORKS

The owner of an original artwork may resell the physical artwork.

The resale of the physical artwork does not, by itself, transfer copyright. Copyright remains with Amélie Gianesin unless it has been expressly assigned in writing.

The owner of an original artwork may not reproduce, print, manufacture merchandise from, or commercially exploit images of the artwork without the necessary authorization.

Any reproduction must not be falsely represented as an original work by Amélie Gianesin.

The certificate of authenticity should be retained by the owner as evidence of provenance.

AmeliArt™ is a trademark used by Amélie Gianesin. The ™ symbol indicates that the mark is being used as an unregistered trademark; it does not indicate federal registration.

Every effort is made to represent the artworks accurately. Differences between an artwork's appearance on screen and its physical appearance may occur due to differences in displays, lighting and colour settings.
Modifications
AmeliArt may update this policy from time to time. The version published on the website will indicate the applicable current policy.
